The Digital Asset Market Clarity Act, also known as the Clarity Act, is stalling in the Senate, creating uncertainty for the U.S. crypto industry. S. crypto industry faces growing uncertainty as the Digital Asset Market Clarity Act, widely known as the Clarity Act, stalls in the Senate. JPMorgan analysts, led by managing director Nikolaos Panigirtzoglou, issued a stark warning today: the bill’s fading prospects could significantly hinder the crypto market’s long-term outlook and deter institutional adoption.

This legislative gridlock, detailed in a report published on July 29, 2026, risks funneling the burgeoning growth from tokenization and blockchain-based applications away from public crypto networks. Instead, these innovations might increasingly be absorbed by existing traditional financial infrastructure, a notable shift from JPMorgan’s more optimistic forecasts earlier this year.

Clarity Act legislative path uncertain

The path for the Clarity Act through the U.S. Senate looks increasingly difficult as key disagreements persist. Prediction markets now reflect this challenge; Kalshi indicates a 37% chance of the bill passing this year.

Polymarket, meanwhile, shows a 38% probability that crypto market structure legislation will become law in 2026. These figures underscore the considerable doubt surrounding the bill’s ability to clear Congress by year-end.

The Senate’s busy calendar ahead of its summer recess means crypto legislation isn’t a top priority right now. Lawmakers remain deadlocked over crucial aspects of the bill, including ethics provisions, enforcement mechanisms, decentralized finance (DeFi) rules, and anti-money laundering (AML) requirements.

While the U.S. Senate returned from recess between July 13-17, a merged version of the bill did not materialize. A vote now seems unlikely before mid-September, when lawmakers return after their August break.

Concerns embedded in the bill itself

Even if the Clarity Act somehow makes it through Congress, JPMorgan analysts have voiced concerns that parts of its current draft could inadvertently discourage institutional participation. They argue that certain provisions might create an uneven regulatory playing field or loopholes.

For instance, the bank highlighted scenarios where DeFi platforms could trade tokenized securities and derivatives entirely outside the jurisdiction of either the Securities and Exchange Commission (SEC) or the Commodity Futures Trading Commission (CFTC). This lack of clear oversight could understandably make institutional players hesitant to engage.

Another point of contention for JPMorgan centers on anti-money laundering rules. The bank suggests that if crypto entities face less stringent AML requirements than traditional banks and broker-dealers, it could compromise market integrity and national security. This imbalance poses a significant risk to broader financial system stability.

The bank warns that this continued delay and the specific problematic provisions reinforce a trend where demand for tokenization and blockchain is being absorbed by existing financial infrastructure. This dynamic creates a genuine headwind for public crypto networks and their development.

Eroding US leadership in crypto

The prolonged absence of a definitive regulatory framework in the U.S. carries substantial implications for the nation’s standing in the global crypto economy. It’s not simply about delaying a single piece of legislation; it’s about shaping the future trajectory of digital asset innovation.

The Crypto Council for Innovation recently emphasized this risk in a 35-page report, warning of potentially serious consequences. “A failure to act now will cede the United States’ historic leadership of market regulation and innovation to other jurisdictions,” the council stated, adding that it could also “threaten U.S. dollar dominance.”

This sentiment echoes concerns from within Congress. Senator Cynthia Lummis (R-WY) expressed her frustration on X on July 29, 2026, stating, “After nearly 11 months of giving almost everything asked of us, I genuinely don’t know what else my Democrat colleagues need before we act.”

The U.S. House of Representatives passed the Clarity Act last July, but its journey has since stalled in the Senate due to ongoing disputes over issues like stablecoin yields and crypto disclosure requirements. Without clear rules, the U.S. risks falling behind other nations that are actively developing more defined digital asset frameworks.
