A crucial vote on the Digital Asset Market Clarity Act, also known as the CLARITY Act, will not occur until September, as the US Senate enters its August recess today. Senate Majority Leader John Thune, a Republican from South Dakota, confirmed the delay for the landmark crypto regulation bill, which aims to establish a federal framework for digital assets.

The postponement comes amidst a political deadlock, primarily over ethics provisions concerning government officials’ involvement in cryptocurrency. Separately, President Donald Trump weighed in on the burgeoning digital asset space, suggesting that more people are now paying with Bitcoin and are less reliant on traditional cash.

Ethics Standoff Halts Crypto Clarity Act Vote

The CLARITY Act, formally known as H.R. 3633, seeks to define regulatory jurisdiction between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) over various digital assets. Its passage would provide much-needed regulatory certainty, protect investors, and foster innovation within the United States.

Lawmakers on both sides of the aisle have put significant work into the bill. It cleared the House of Representatives in July 2025 with strong bipartisan support, passing 294-134. More recently, in May 2026, the Senate Banking Committee advanced its version of the bill by a 15-9 vote.

However, Democratic senators have made it clear that their support for a floor vote hinges on stronger ethics provisions. These contentious clauses would bar federal officials, including the president, and their spouses from issuing or sponsoring digital assets for financial gain while in public service.

Majority Leader John Thune acknowledged this impasse, stating on August 6, 2026, that “The Dems insisted on no Clarity vote.” He indicated that the bill would be a top priority once lawmakers return to Washington on September 14, 2026.

Behind the Delay: Unresolved Legislative Issues

Beyond the high-profile ethics debate, other unresolved issues contributed to the legislative pause. These include provisions related to illicit finance and agricultural commodity concerns.

New York Attorney General Letitia James also submitted written testimony on July 28, 2026. She urged amendments to preserve state authority in consumer protection and fraud prosecution. James also advocated for extending the proposed ethics ban to a two-year post-service period, highlighting ongoing concerns about potential conflicts of interest.

The latest 616-page draft of the CLARITY Act, which began circulating in July, incorporates new law enforcement and ethics provisions developed in conjunction with the White House. This section includes the ban on government officials promoting or profiting from crypto, with a sunset clause in 2029.

Despite these additions, the debate remains fierce. Senator Elizabeth Warren, a Democrat from Massachusetts and a long-time critic of the bill, has claimed that the legislation, even with its new language, could still benefit President Donald Trump and his family.

Donald Trump Weighs In on Bitcoin Adoption and National Leadership

Amid the legislative gridlock, President Donald Trump offered his perspective on the growing role of Bitcoin and other cryptocurrencies. In an interview with Punchbowl News posted on August 7, 2026, he emphasized their increasing utility.

“Crypto is a big deal. I mean, I see it more and more where people are paying with Bitcoin, and you know they don’t even know about cash anymore,” President Trump said. His comments highlight a perceived shift in payment habits among the public.

The President also framed the adoption of crypto as a matter of national interest. “If we don’t have it, China’s going to have it,” he warned, suggesting that the United States needs to maintain a leading position in the digital asset space, particularly concerning crypto and artificial intelligence.

President Trump also linked Bitcoin use to broader economic benefits for the country. He argued that widespread use of digital currencies “takes a lot of pressure off our dollar,” suggesting it could be “a good thing for our country.”

The Ethics Question and Political Scrutiny

President Trump’s pro-crypto stance and his family’s digital asset ventures have faced scrutiny in Washington. His memecoin, $TRUMP, and the World Liberty Financial project have drawn criticism regarding potential conflicts of interest from some lawmakers.

The White House has consistently denied any conflicts. President Trump himself addressed the ethics concerns in his Punchbowl News interview, pointing out that Democrats have also profited from stock trading. “They want a bill, and in the bill they want me to be different to everyone else,” he commented, referring to the proposed ethics provisions.

This political dimension underscores the complexities surrounding the CLARITY Act. While both major parties agree on the need for crypto regulation, the specifics, particularly those touching on personal financial gains by public figures, remain a significant hurdle.

Industry heavyweights like Goldman Sachs and Fidelity, alongside various law enforcement groups, have publicly backed the CLARITY Act. They view regulatory clarity as essential for bolstering investor confidence and maintaining the competitiveness of the U.S. in global digital asset markets.

Outlook for the Crypto Clarity Act

With the Senate now in recess, the fate of the CLARITY Act hangs in the balance until September. The bill needs 60 votes to overcome a potential filibuster and advance to a final vote.

Current predictions suggest an uphill battle. As of August 6, 2026, prediction market Kalshi placed the odds of the CLARITY Act becoming law in 2026 at a record low of approximately 20%. Global prediction market Polymarket gave it even lower odds, at 14%.

The delay highlights the deep divisions and intricate political considerations impacting cryptocurrency legislation. Senator Cynthia Lummis, a Republican from Wyoming and a key sponsor, has been a vocal advocate for the bill, pushing for a clear legal framework. However, the insistence by Democrats on robust ethics language illustrates the challenges of forging a consensus in this politically charged environment.

The coming weeks will be critical. When the Senate reconvenes in mid-September, lawmakers will face renewed pressure to address the outstanding issues. The crypto industry and market participants will be closely watching whether Washington can finally deliver a comprehensive regulatory framework, or if the bill will continue to languish amidst partisan disagreements and ethical considerations.
