Tether USDT faces two-year countdown for U.S. compliance

Tether’s USDT, the crypto market’s largest stablecoin by volume, is now on a two-year countdown to meet new American stablecoin regulations. If it fails to comply with the U.S. Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act, USDT risks being removed from U.S. crypto platforms.

The GENIUS Act, signed into law by President Donald Trump on July 18, 2025, requires stablecoin issuers to maintain full reserves in highly liquid assets, such as cash and U.S. Treasuries. This legislative move sets a definitive timeline, with full enforcement slated to begin in 2028, significantly impacting how stablecoins like USDT operate within the U.S. market.

Tether’s reserve holdings pose compliance challenge

The core requirement of the GENIUS Act centers on strict reserve asset composition. Issuers must ensure their stablecoins are fully backed by the most reliable and liquid assets available. This primarily means cash and U.S. government securities, designed to bolster stability and protect consumers.

Tether CEO Paolo Ardoino has previously affirmed the company’s intention to comply with the GENIUS Act. However, recent disclosures indicate that approximately 25% of USDT’s reserves are still held in assets that won’t meet these upcoming U.S. standards. These include holdings in precious metals, lending, and Bitcoin (BTC), presenting a substantial hurdle for Tether.

Moving these reserves into GENIUS Act-compliant assets, predominantly cash and U.S. Treasuries, represents a significant financial and strategic shift for Tether. Such a transition requires careful divestment from current holdings and a complete re-evaluation of its long-standing treasury management approach. This underscores the profound impact the GENIUS Act could have on Tether’s global operations.

Regulatory timelines face delays and uncertainty

Despite the clear legislative roadmap, U.S. federal regulators missed a crucial deadline on July 18, 2026, for finalizing the implementing rules of the GENIUS Act. This delay has introduced an element of uncertainty for stablecoin issuers and the U.S. platforms where they’re listed. While the law itself outlines the broad requirements, the specific details of its enforcement remain pending.

This regulatory gap has led to differing interpretations regarding the three-year grace period provided by GENIUS, particularly concerning foreign issuers. The full enforcement of the act is set to begin in 2028, and the transition period for U.S. digital asset service providers to comply ends around mid-2028.

Final rules for Bank Secrecy Act (BSA) compliance, which are part of the broader regulatory framework, are anticipated in early 2027. These will follow a joint proposed rule issued by the Treasury Department, the Financial Crimes Enforcement Network (FinCEN), and the Office of Foreign Assets Control (OFAC) on April 8, 2026. This staggered approach adds complexity to the compliance landscape.

The path toward federal stablecoin regulation

The GENIUS Act is a landmark piece of U.S. crypto legislation, but it’s only part of an evolving regulatory picture. U.S. regulators, including the Treasury Department, FinCEN, OFAC, the Office of the Comptroller of the Currency (OCC), the Federal Deposit Insurance Corporation (FDIC), the National Credit Union Administration (NCUA), and the Federal Reserve, are all involved in implementing the act.

The coming months will see continued efforts to solidify these regulatory frameworks. The decisions made by Tether regarding its reserve adjustments and its U.S. market strategy will be critical. How these regulations are ultimately navigated could redefine the competitive landscape among stablecoin issuers.

For Ethereum, where a significant portion of USDT’s issuance and transaction volume resides, these regulatory shifts could have cascading effects. The requirement for compliant, fully-backed stablecoins could influence liquidity and trading patterns on decentralized finance (DeFi) protocols and other applications built on the network.

The next two years will be transformative for Tether and the broader stablecoin sector, shaping the future of digital dollar usage within the world’s largest economy.
